Tato stať je zamýšlena jako úvod do spojité problematiky explikace pravdivosti a sémantic-kých paradoxů, které onu explikaci pronásledují. Tyto paradoxy jsou viděny jako prostředek ukázání, že nedostatečně promyšlená explikace našeho pojmu pravdivosti (významu pravdi-vostního predikátu) je explikací nevyhovující. Poté jsou předvedeny rysy obou klasických přístupů, Russellovy teorie typů a Tarského hierarchie metajazyků. Nakonec jsou podány zá-kladní ideje hlavních názorových škol, které přišly poté.

Este artigo suscita uma reflexão sobre a condição que muitas mulheres negras ainda vivem na sociedade brasileira. Nesta breve análise examinamos as memórias coletivas dos grupos dominantes e dominados desde o contexto da escravidão brasileira até a sociedade atual tomando como base a teoria da memória de Maurice Halbwachs e Michael Pollak, recorremos também aos estudos de algumas feministas negras, a exemplo de Grada Kilomba, Bell Hooks, Sueli Carneiro e Chimamanda Adichie e também da feminista Heleieth Saffioti, que abordam o (...) viés da interseccionalidade e escancara as desigualdades, opressões e violências enfrentadas pelas mulheres negras. Assim, a partir de uma análise qualitativa, podemos afirmar que: i) a memória coletiva de grupos da elite branca é memória oficial e reflete o modelo de relações raciais do Brasil; ii) a memória e o esquecimento marcam a trajetória do povo negro; iii) o projeto colonial se apresenta com novas roupagens do racismo. Researchers sometimes engage in various forms of dishonesty and unethical behavior, which has led to regulatory efforts to ensure that they work according to acceptable standards. Such regulation is a difficult task, as research is a diverse and dynamic endeavor. Researchers can disagree about what counts as good and acceptable standards, and these standards are constantly developing. This paper presents and discusses recent changes in research integrity and ethics regulation in Norway, Denmark, and Sweden. Recognizing that research norms are developed (...) through practice and are therefore unsuited for comprehensive national regulation, the Scandinavian countries focus on empowering the research community to regulate itself instead, except for the most severe cases of misconduct. This empowerment takes the form of giving research institutions tools and investigatory powers while also holding them responsible for ensuring that both the institution and individual researchers are up to date on relevant norms. In this way, the Scandinavian governments seek to avoid some of the challenges found in more legalistic approaches, which risk lagging behind the continuous development of research norms and can be insensitive to the fact that different disciplines have different norms. While the new approach in Scandinavian has several potential benefits, it also involves potential trade-offs and limitations. The new laws can create confusion about what researchers are allowed to do. Another issue is that it only addresses the fundamental drivers of misconduct to a limited extent. (shrink)

This paper presents the results of a study of the effect of a business ethics course in enhancing the ability of students to recognize ethical issues. The findings show that compared to students who do not complete such a course, students enrolled in a business ethics course experience substantial improvement in that ability.

A considerable literature exists regard-ing the moral obligation to keep one's promises. Several authors have focused on the exceptional circumstances which may or should excuse this moral duty. Less frequently discussed is the question of how this general moral obligation and its possible exceptions play out in the context of negotiable written promises to pay money, i.e., so-called "commercial paper."This paper focuses on the application of the legal rules governing commercial paper, and on the ethical implications involved in the application (...) of those rules. More specifically, it asks whether the assertion of the technical doctrine known as "holder in due course," and the denial of that status in some cases, promotes ethical behavior in the marketplace. By examining the circumstances of one case, involving a substantial investment and a large bank, I hope to shed some light on how the legal and ethical rules do in fact "intersect.". (shrink)

Cross cultural ethical conflicts are a major challenge for managers of multinational corporations (MNEs) when an MNE's business practices and a host country's practices differ. We develop a set of decision principles to help MNE managers deal with these conflicts and illustrate with examples of ethical conflicts faced by MNEs doing business in contemporary Russia (DeGeorge, 1994). We discuss the generalizability of the principles by comparing them to the Donaldson (1989) and Buller and Kohls (1997) decision models. Why do humpback whales sing? This paper considers the hypothesis that humpback whales may use song for long range sonar. Given the vocal and social behavior of humpback whales, in several cases it is not apparent how they monitor the movements of distant whales or prey concentrations. Unless distant animals produce sounds, humpback whales are unlikely to be aware of their presence or actions. Some field observations are strongly suggestive of the use of song as sonar. Humpback whales sometimes stop (...) singing and then rapidly approach distant whales in cases where sound production by those whales is not apparent, and singers sometimes alternately sing and swim while attempting to intercept another whale that is swimming evasively. In the evolutionary development of modern cetaceans, perceptual mechanisms have shifted from reliance on visual scanning to the active generation and monitoring of echoes. It is hypothesized that as the size and distance of relevant events increased, humpback whales developed adaptive specializations for long-distance echolocation. Differences between use of songs by humpback whales and use of sonar by other echolocating species are discussed, as are similarities between bat echolocation and singing by humpback whales. Singing humpback whales are known to emit sounds intense enough to generate echoes at long ranges, and to flexibly control the timing and qualities of produced sounds. The major problem for the hypothesis is the lack of recordings of echoes from other whales arriving at singers immediately before they initiate actions related to those whales. An earlier model of echoic processing by singing humpback whales is here revised to incorporate recent discoveries. According to the revised model, both direct echoes from targets and modulations in song-generated reverberation can provide singers with information that can help them make decisions about future actions related to mating, traveling, and foraging. The model identifies acoustic and structural features produced by singing humpback whales that may facilitate a singer’s ability to interpret changes in echoic scenes and suggests that interactive signal coordination by singing whales may help them to avoid mutual interference. Morality is a normative system of guidance that figures into practical reason by telling people what to do in various situations. The problem, however, is that morality has inherent gaps that often render it inefficacious. First, it may be indeterminate due to the high level of generality in which its principles are formulated. Second, moral terms such as ‘good’ and ‘right’ may be so vague that they fail to specify the requisite behavior. And third, its subjective aspect, which is a (...) product of personal experience, generates moral disagreement and thereby creates coordination problems that frustrate society’s collective moral aims. The objective of this article is to advance the thesis that morality must sometimes depend on law as a supplementary source of practical reason, a dependence which can be explained in terms of three essential features of law: its institutional character, its claim to authority, and its status as a second-order exclusionary reason for action. It shall then be explained how these three features enable law to make difficult decisions on behalf of individuals, define objective standards of conduct, and solve coordination problems, respectively, and in doing so, manage to fill in the gaps of morality mentioned above. Hence, it will be argued that law is also a normative system that helps people achieve their moral aims, notwithstanding the fact that it guides human behavior through a different logic and mode of operation from those of morality. Management practitioners and scholars have worked diligently to identify methods for ethical decision making in international contexts. In this paper we offer sixheuristic questions to help corporate managers resolve cross-cultural ethical conflicts involving questionable business practices in a host country. Our aim is to provide practical guidance for discussion within a firm on whether or not to do business the firm’s way, the host’s way or refrain from doing business there (the highway).

In the early 1990s, managers at Exxon decided to seek lower cost disposal in Louisiana for oil-field wastes declared hazardous in Alabama. This decision resulted in injuries to the residents of Grand Bois, Louisiana; the disposal company; Exxon; and the oil industry in the state. Given the need for business and society to manage business operations for mutual benefit, it is essential to understand why businesses injure the public so that similar incidents do not happen again. The authors use three (...) analytical perspectives to suggest how corporations may make unethical decisions without purposefully setting out to do so: their managers may fail to understand changing social expectations for corporate behavior; they may adopt organizational structures, policies, and procedures that block ethical action in the name of efficiency; and they may follow unwritten rules of behavior for career success that exclude ethics. These perspectives suggest that individual Exxon managers may not have been making greed-based decisions, weighing corporate gains against harms to others. The situation more likely involved a failure, for the reasons discussed, to raise ethics questions in making business decisions. This explanation does not make much difference to those injured nor does it absolve those who made the decisions. It does make a difference to society and to companies seeking to understand factors that have to be overcome in any large corporation that wishes to prevent such events from occurring. (shrink)

This paper will examine the implications of an extended “field theory of information,” suggested by Wolfhart Pannenberg, specifically in the Christian understanding of creation. The paper argues that the Holy Spirit created the world as field, a concept from physics, and the creation is directed by the logos utilizing information. Taking into account more recent developments of information theory, the essay further suggests that present creation has a causal impact upon the information utilized in creation. In order to adequately address (...) Pannenberg's hypothesis that the logos utilizes information at creation the essay will also include an introductory examination of Pannenberg's Christology which shifts from a strict “from below” Christology, to a more open “third way” of doing Christology beyond “above” and “below.” The essay concludes with a brief section relating the implications of an extended “field theory of information” to creative inspiration, as well as parallels with human inspiration. This paper revisits William James's 1906 speech, "The Moral Equivalent of War," to look at the relationship of religion, particularly Christianity, to war and violence. Beginning with an anthropological update concerning "biological or sociological necessity," which confirms James's anti-mystical view of war, this paper then offers a case that monotheism, including Christianity, has an extremely ambiguous relationship with war and violence. There is evidence both that doing away with monotheism would have little effect on the prevalence of war and that (...) monotheism supports war in post-neolithic cultures. Finally, it seems the contribution James makes cannot be seen until the distinction between religion and philosophy is put aside. Only then can we see his suggestion that the proper role of intellectual leaders is to offer persons with politico-military power informed advice concerning actions that will result in fewer actual wars. It is rare that any kind of consensus is reached when such discrepancies surface. Some of this is due to honest disagreement among genuinely reflective and open-minded individuals, but it is becoming more obvious that a large and perhaps growing portion of this problem stems from misunderstandings about the nature of these concepts themselves. IN THE PAST THREE YEARS, TWO IMPORTANT CATHOLIC MORAL THINKERS—both well-respected Thomists—have published books on the natural law. Besides offering their own significant contributions to natural law thought, Jean Porter and Russell Hittinger each insightfully surveys developments in natural law thinking from the scholastics, into the early modern period, through today. In importantly similar narrations of the history of natural law, both Porter and Hittinger claim that natural law in the modern period has been understood as a source of specific (...) moral norms that is independent of belief commitments and compelling to all rational creatures, even shorn of—in fact, precisely because it is shorn of—these authoritative commitments. However, both authors claim that this understanding of natural law is highly problematic. If the goal of natural law inquiry is a set of "independent" and "compelling to all" particular norms existing "free-floating" in an "authority-free zone," impossible demands have been made of natural law. Both Porter and Hittinger must and indeed do honor the notion of natural law as universally applicable and binding. Yet both acknowledge that something is necessary, beyond the specific norms of the natural law themselves, in order to identify and justify those norms. (shrink)

Li Zehou, in contrast, places free will at the center of his reading of classical Confucian ethics. Is this too interpretive? Does it do violence to the concept of free will, or to classical Confucian morality? Scholars from a variety of disciplines have expended a lot of energy in attacking and defending the Wimsatt-Beardsley position. Their efforts fall mainly into two classes. Either they have been exploratory with respect to the nature of the concept ‘intention’, but so exploratory as to present no tangible discovery; or they have (...) merely been occasions to air the author’s own views, views which take sides, but views which in the end only serve to define what positions may be taken without really convincing anyone whether one position is clearly better than the other. This dilemma is really rather odd because in a certain sense it is pitifully easy to understand what the intentional fallacy amounts to. There is a kind of minimal meaning to it, and I suspect that introductory students in courses in Aesthetics and Criticism have little difficulty in understanding it. ‘Difficulties’ seem to arise primarily in connection with its implications and general scope within the totality of criticism. However, it would be wrong to conclude that these difficulties have nothing to do with the intentional fallacy. They do. The doctrine of double effect shows that for which the moral agent is responsible, by explicating the relationship between the act directly intended and the consequences of that act. I contend that this doctrine is necessary not only for natural law absolutism, but also for Donagan's Kantianism and for Quinn's revised construal of the doctrine, and even for consequentialism, as bioethical implications of the doctrine make clear. Salespeople have a moral obligation to prospect/customer, company and self. As such, they continually encounter truth-telling dilemmas. "lgnorance" and "conflict" often block the path to morally correct sales behaviors. Academics and practitioners agree that adoption of ethical codes is the most effective measure for encouraging ethical sales behaviors. Yet no ethical code has been offered which can be conveniently used to overcome the unique circumstances that contribute to the moral dilemmas often encountered in personal selling. An ethical code is developed (...) that charts ethical paths across a variety of sales settings (addressing "ignorance") while illustrating why the cost associated with acting morally is generally reasonable (addressing "conflict"). The code applies the universal transactional notions of customer expectations and salesperson reputation to illustrate why and when salespeople are morally required to tell the truth. In doing so, the code tackles head-on the vexing question of how best to juggle mixed motives - involving self-interests, corporate-concerns, cus-tomer-needs and other influences such as the nature of the transaction. The issue of how mixed motives can be dealt with through moral means is one that ethicists have previously sidestepped (Stark, 1993). (shrink)

In 2009, the United States Air Force aired a series of science fiction-themed recruitment commercials on network television and their official YouTube channel. In these advertisements, the superimposition of science fiction imagery over depictions of Air Force operations frames these missions as near-future sci-fi adventure, ironically summarized by the tagline: “It’s not science fiction. It’s what we do every day.” Focusing on an early advertisement for the Air Force’s Reaper unmanned aerial vehicle, this essay explores how themes essential to the (...) science fiction genre play a role in influencing contemporary attitudes about autonomous and semi-autonomous robotic weapons, as well as the way in which the aesthetic and functional qualities of these advanced technologies are used to frame moral arguments about their use. As a reconfiguration of the near-future battleground in the guise of science fiction, the “Reaper” ad reveals the way in which science fiction has come to serve as a functional-aesthetic benchmark and cultural sounding board, against which “every day” technologies can be measured and claims about their value, ethos, and social appeal are made. This essay explores the ethical entanglements between science fiction film and video games, and military technology, and the complex role science fiction plays in influencing public attitudes towards military technologies. Law is a specialized semiotic realm, but lawyers generally are ignorant of this fact. Lawyers may manage meaning, but they also are managed by meaning. Seemingly trapped by the weight of pre-existing signs, their attempts to manage these meanings generally are limited to technical interventions and instrumentalist strategies. Signs have power over lawyers because they are embedded in narratives, a semiotic economy that confronts the lawyer as “given” even though it is dynamic and constantly under construction. Most lawyers do not (...) make meaning through legal narratives; rather, they parrot bits of the controlling narratives in response to certain problems. Because clients often can achieve their objectives when their lawyers crudely manipulate the symbols of law, these endeavors pay very well. Well-paid lawyers tend not to ask too many questions. Consequently, semiotics is, at best, misunderstood by lawyers; more likely it is wholly unknown. A lawyer’s avowed instrumentalism is the very problem to be addressed in this regard. For the scope of discussion, I refer to Vico’s famous On the Study Methods of Our Time and draw my conclusion for the lawyer of our time. (shrink)

This article aims to show the objections made by Arthur Schopenhauer (1788-1860) to Immanuel Kant’s doctrine of right (1724-1804). Based on the main Schopenhauer’s work we’ll be able to explain the five points of disagreement between Schopenhauer and Kant: (i) Kant tries to separate right sharply from ethics; (ii) the definition (Bestimmung) of the concept of right; (iii) the right to property (what is the basis of this right and if its exists outside the State); (iv) the purpose of the (...) The United Nations, through the work of Special Representative to the Secretary-General John Ruggie, has developed a framework seeking to clarify the responsibilities of businesses related to human rights. However, this framework adopts a limited, “do no harm” expectation for corporations that fails to capture the positive role that corporations can play in this social responsibility domain. In this paper (...) we take up the institutional pressures affecting corporations with regard to human rights, summarize some of the critiques of the Ruggie framework, offer moral imagination and stakeholder engagement as complements to this framework’s current approach, and conclude with a dialectical analysis that in time might lead to a new consensus in this area. While it is generally assumed that large corporations today give rhetorical support for basic human rights in public relations documents, skepticism continues toarise about the behavior of these firms. Do company actions support their rhetoric? This paper provides the initial analysis of our study of both rhetoric and practice regarding human rights in a small sample of large U.S. firms. At this point in the analysis, UNGC membership does not appear to have much influence on corporate rhetoric, but may be (...) partially correlated with several measures of corporate performance on human rights issues. This volume examines themes that complicate the conventional economist's view of the world and thereby provide for a notably more complex, and humane, subject of study than the traditional Homo economicus. Written by economists and philosophers, these essays attempt to place neoclassical economic theory, especially conventional textbook micro-economic theory, in the broader context of other social sciences and modern economics. In doing so, the book aims to find the boundaries of economics and to define more sharply its relationship to other (...) kinds of inquiry. Citizenship is the right to be a citizen of a social, political, or national community. Aristotle was the philosopher who has been talking about citizenship since ancient times. His thoughts are still historical lessons for the operation of states today. In this article, the author focuses on analyzing basic thoughts on Aristotle's citizenship; which are shown in essential points such as (i) Citizenship is clearly shown in the role of the State, (ii) Right to education, (iii) The right to participate (...) in political affairs, (iv) Citizenship is associated with civic obligations. Thereby, the article draws its historical lesson for the current building of law-governed State in Vietnam in the following aspects: (i) Building a solid-state apparatus with a coherent and unified legal system; (ii) All the State's policies must originate from the Vietnamese practice, ensure the people's mastery and protect the people's legitimate interests; (iii) Consolidating and strengthening the relationship between the State and the people. A pesquisa a priori se propôs realizar um esboço etnográfico das quatro comunidades quilombolas no médio sertão maranhense, atentando para os elementos intrínsecos da produção de conhecimentos. Como suporte metodológico, as interlocuções seguiram pelo viés dos estudos que privilegiam as alteridades e os saberes locais como pressupostos analíticos fundamentais. Nessa perspectiva, procuramos nos afastar da maioria dos estudos voltados para comunidades quilombolas que trazem como abordagem central, as lutas fundiárias, o reconhecimento por direitos, no entanto, compreendemos que essas abordagens são (...) fundamentais como marco de compreensão das lutas políticas. As comunidades quilombolas aqui pesquisadas somente foram certificadas pela Fundação Palmares no ano 2006, porém há mais de meio século essas comunidades mantém entre si relações de sociabilidade e intercâmbios culturais. Não obstante, a nossa busca de conhecimento está pautada nos saberes, nas trajetórias e nas concepções de espaço social referenciado na alteridade. Dessa forma, procuraremos captar os processos de criatividade cosmopolítica, sociocosmológica e antropológica, dando ênfase para as suas próprias elaboração e construção de conceitos. Para esse fim, o trabalho de campo foi um instrumental metodológico de suma importância, aliado a outras metodologias, por exemplo, a história oral, a etnohistória e os cuidados com a linguagem local, elementos fundamentais inerentes às ciências sociais. O nosso objetivo é propor um diálogo entre Husserl e Heidegger relacionando-os a partir da crítica que estes filósofos apresentam à investigação de viés naturalista acerca do homem, predominante na tradição filosófica. Para Husserl, o domínio do naturalismo representa a influência da Psicologia Experimental na filosofia, Heidegger, por sua vez, destaca a temática antropológica encontrada na história da filosofia. De acordo com o primeiro, o “psicologismo” acarreta na redução do homem aos seus componentes empíricos, para o segundo, o “antropologismo” equivale (...) a um processo de coisificação do homem. O “psicologismo” e o “antropologismo” são reflexões inadequadas pois equiparam o homem ao objeto natural, isto é, são reflexões que não consideram o verdadeiro sentido de ser do homem, ignorando a consciência intencional e a existência. Logo, Husserl e Heidegger compartilham a tentativa de fazer a filosofia retornar sobre aquele âmbito que compõe propriamente o homem, ou seja, ambos filósofos defendem a desnaturalização da reflexão e desenvolvem a fenomenologia como o exercício de tal retorno. The authors address problems with “compulsory” arbitration clauses in contracts. Specifically, they note that consumers are misguided about their rights in such cases. In addition, arbitration clauses do not allow the press to cover any proceedings that may result. The arbitration clauses in contracts are written in legalese that consumers do not understand. The authors found that even university students had difficulty understanding the information in such clauses. An example of an actual case is included.
